These Terms of Use (hereinafter referred to as “these Terms”) set forth the conditions governing the use of the website (hereinafter referred to as “this Site”) operated by the Japan-Myanmar Aikido Association, a Specified Nonprofit Corporation (hereinafter referred to as “the Association”), as well as the seminars, training sessions, international exchange activities, and other programs (hereinafter collectively referred to as “the Services”) announced, advertised, or provided through this Site.
Any person using this Site or the Services (hereinafter referred to as the “User”) must review the contents of these Terms and agree to them before using the Site or the Services.
Article 1 (Purpose of the Association)
The Association operates with the purpose of supporting the healthy development of youth, primarily in Myanmar and other parts of Southeast Asia, through Aikido, while promoting mutual understanding and international exchange that transcend differences in nationality, ethnicity, religion, and culture.
Revenue generated by the Association from seminars and other activities, after deducting necessary operating expenses, shall be used for non-profit activities consistent with the Association’s purpose, including the promotion of Aikido, the training of instructors, international exchange, the dispatch of instructors, and the invitation of trainees.
Article 2 (Application of These Terms)
These Terms apply to the relationship between the Association and users regarding the use of this website and the Services.
If the Association posts specific conditions, precautions, participation guidelines, or cancellation policies on this website, application pages, via email, or in notices for individual seminars, such provisions shall constitute part of these Terms.
In the event of any conflict between these Terms and any specific notices, etc., these Terms shall prevail unless such specific notices, etc., clearly stipulate otherwise.
Article 3 (Content of the Services)
The Association primarily provides information, accepts applications, and offers other services related to the following activities:
Organizing Aikido seminars, training sessions, demonstrations, and other events
Instruction and training in Aikido, including techniques involving swords, staffs, and other weapons
Dispatching instructors to Myanmar and other countries and regions, and conducting exchange programs
Inviting, hosting, and supporting trainees and Aikido practitioners from overseas
Training Aikido instructors and fostering youth development
Providing videos, photographs, articles, and other Aikido-related content
Accepting donations, sponsorships, and other forms of support
Activities incidental or related to the preceding items
Article 4 (Eligibility for Use)
This website is open to the public.
Participation in seminars and other events may be subject to conditions such as age, years of experience, rank, health status, affiliated organization, insurance coverage, and other requirements.
As a general rule, minors must obtain the consent of a parent or other legal guardian before applying for paid services or participating in events.
The Association may request that applicants confirm their health status, Aikido experience, and other necessary details if deemed necessary for safety management or event operations.
Article 5 (Application and Formation of Contract)
Users shall apply by following the application procedures prescribed by the Association and providing accurate and up-to-date information.
The Association shall not be liable for any disadvantages arising from an applicant providing false, inaccurate, or incomplete information, except in cases where the Association is found to have acted with intent or gross negligence.
Contracts for paid seminars and other services provided by the Association shall be formed at the earlier of the time the Association notifies the applicant of its acceptance of the application or the time the Association confirms receipt of payment for participation fees, etc.
The Association may refuse to accept an application if capacity is exceeded, participation requirements are not met, there are safety concerns, or for any other reasonable cause.
Users may not transfer their eligibility to participate or their status as an applicant to a third party without the Association’s prior consent.
Article 6 (Participation Fees and Payment Methods)
Participation fees for workshops, training sessions, and other events will be displayed on the event information page or application page for each event.
Users shall pay participation fees by the deadline specified by the Association via bank transfer, online payment, on-site payment, or other methods designated by the Association.
Unless otherwise specified in the event information, users shall bear any bank transfer fees, payment processing fees, or other costs associated with payment.
The Association may change the amount of participation fees or payment methods as necessary. However, for contracts concluded prior to such changes, the terms in effect at the time of application shall apply unless otherwise agreed.
Article 7 (Cancellation by Users)
If a user wishes to cancel a seminar or other event, the user shall promptly notify the Association using the method specified by the Association.
Cancellation fees and refund conditions shall be in accordance with the terms stated on the information or registration page for each event.
Bank transfer fees and other actual expenses incurred in processing a refund may be deducted from the refund amount, except in cases where the cancellation is attributable to the Association.
The cancellation conditions set forth in the event information or in this Article shall also apply to non-attendance due to the participant’s illness, injury, transportation delays, denial of a visa, or other personal circumstances. However, this shall not apply if the Association recognizes special circumstances.
Article 8 (Changes, Cancellations, or Postponements by the Association)
The Association may change the content, date, time, venue, instructors, or format of an event, or may cancel or postpone an event, due to an instructor’s illness or injury, unavailability of the venue, natural disasters, inclement weather, outbreaks of infectious diseases, suspension of public transportation, war, political upheaval, public safety issues, requests from government agencies, or other unavoidable circumstances.
If the Association decides to cancel a paid event without scheduling an alternative date, the Association will, in principle, refund any participation fees already received.
Even in the case described in the preceding paragraph, the Association will not be liable for any transportation costs, lodging expenses, visa acquisition fees, travel cancellation fees, or other incidental expenses incurred by participants, unless the Association is found to have acted with intent or gross negligence.
If the primary purpose of the event is maintained despite changes such as switching to an online format, changing the venue, or changing the instructor, the Association will reasonably determine whether a refund is granted and the extent thereof, taking the details of the changes into consideration.
Article 9 (Aikido Training and Safety Management)
Aikido training may involve throws, breakfalls, joint locks, and the use of wooden swords, staffs, and other training equipment, which may result in bruises, sprains, fractures, or other injuries.
Participants shall participate at their own risk, taking into account their physical fitness, skill level, and health condition, and shall not overexert themselves.
If a participant has an illness, injury, is recovering from surgery, or has any other condition that may affect their ability to practice, they must, as necessary, obtain a medical diagnosis or permission from a physician in advance and report this to the instructor or an administrator.
Participants shall comply with the instructions of the instructor and venue manager, safety precautions, and the facility’s rules of use.
Participants shall be considerate of other participants’ age, experience, physical build, and health condition, and shall not engage in dangerous or excessive training.
If deemed necessary for safety reasons, the Association may require participants to suspend training, switch to observer status, restrict the techniques or equipment used, leave the venue, or take other necessary measures.
The Association recommends that participants obtain sports safety insurance, accident insurance, travel insurance, or other appropriate insurance. Depending on the event, insurance coverage may be a condition of participation.
Article 10 (Prohibited Acts)
Users must not engage in the following acts when using this website or these services:
Acts that violate laws and regulations, public order and morals, or these Terms of Use
Submitting applications using false information or impersonating a third party
Acts that infringe upon the rights, reputation, honor, or privacy of the Association, instructors, participants, affiliated organizations, or other third parties
Acts of violence, intimidation, discrimination, harassment, nuisance, or dangerous behavior toward other participants
Engaging in dangerous training that violates an instructor’s instructions, intentionally injuring another person, or improperly using training equipment
Engaging in political activities, religious activities, sales, solicitation, advertising, signature campaigns, or other activities unrelated to the purpose of this Service without the Association’s permission
Acts that interfere with the operation of this Website or this Service
Transmitting or providing computer viruses or other harmful programs
Acts of unlawfully obtaining, altering, deleting, or using information on this website
Recording, videotaping, photographing, or live-streaming workshops without the Association’s permission
Reproducing, reprinting, selling, or distributing the Association’s or a third party’s copyrighted works without permission
Any other acts that the Association reasonably deems inappropriate
Article 11 (Suspension of Participation and Restrictions on Use)
If a user violates these Terms of Use, or if there is a risk that the user’s actions may hinder the safe or proper operation of the service, the Association may, without prior notice, suspend the user’s participation, request the user to leave, cancel the user’s registration, or refuse future participation.
If the measures described in the preceding paragraph are taken due to reasons attributable to the user, the Association may not refund the participation fee.
If the Association or a third party suffers damage as a result of a user’s conduct, the user shall compensate for such damage in accordance with their degree of liability.
Article 12 (Photography and Video Recording)
The Association may take photographs or record videos of seminars and other events for the purposes of documenting activities, public relations, activity reports, reporting to supporters, promoting Aikido, and recruiting participants.
The photographs or videos taken may be published on the Association’s website, social media, in printed materials, activity reports, promotional materials, press releases, and other media.
When photographing a specific participant as the main subject for promotional purposes, the Association will, as a general rule, obtain the individual’s consent.
For photography typically expected as part of event documentation—such as group photos, demonstrations, general views of the seminar venue, or participants appearing in the background—the Association may use such images while giving due consideration to the participants’ personal interests.
Participants who do not wish to appear in photographs or videos should notify our association before the event begins. To the extent possible, our association will adjust the shooting position, exclude the participant from the published material, or take other appropriate measures.
When users photograph other participants or post such images on the Internet, they must give due consideration to portrait rights, privacy, and safety—such as by obtaining the consent of the subjects.
Article 13 (Intellectual Property Rights)
Copyrights, trademark rights, and other rights pertaining to text, photographs, videos, audio, charts, designs, logos, training materials, and other content posted or provided on this website and through this service belong to our association or to third parties holding legitimate rights.
Users may not reproduce, reprint, modify, distribute, publicly transmit, sell, or use the content for commercial purposes without our association’s prior permission, except within the scope permitted by law for personal use or other purposes.
Users must not make any representations that could mislead others into believing that the techniques or training methods taught in our workshops have been officially recognized or certified by a specific school, instructor, or organization.
Article 14 (Donations and Financial Support)
Donations and financial support provided to our Association will be used for activities and operations consistent with the Association’s objectives.
Donations solicited for a specific purpose will be used in accordance with that purpose. However, due to social conditions, local security, restrictions on remittances, or other unavoidable circumstances, such donations may be used for the same or a similar public interest purpose.
As a general rule, donors may not request a refund after making a donation for any reason of their own choosing. However, this does not apply in cases of duplicate payments, input errors regarding the amount, or other circumstances deemed reasonable by the Association.
Except as required by law or with the donor’s consent, our organization will not disclose the donor’s name, donation amount, or other information to third parties.
The applicability of tax incentives varies depending on our organization’s legal status, the donor’s circumstances, and relevant laws and regulations. Users are responsible for confirming details with the tax office or a tax accountant as necessary.
Article 15 (Handling of Personal Information)
The Association will use the personal information obtained from users—including names, contact information, affiliations, ages, rank levels, information necessary for health and safety, payment information, and other personal information—for the following purposes:
(1) Accepting applications for seminars and other events, verifying identity, and communicating with users
(2) Confirming receipt of participation fees, donations, and other payments, and processing accounting records
(3) Conducting seminars, ensuring safety management, securing insurance coverage, and responding to emergencies
(4) Providing information regarding the Association’s activities, events, and support programs
(5) Responding to inquiries, consultations, complaints, and similar matters
(6) Reporting on the Association’s activities, improving operations, and preventing fraudulent use
(7) Compliance with laws and regulations
Except as permitted by law, the Association will not use personal information beyond the scope of the intended purposes or provide it to third parties without the individual’s consent.
The Association may outsource payment processing, email distribution, website operation, insurance procedures, event management, and other operations to external service providers. In such cases, we will allow the contractor to handle personal information to the extent necessary and will ensure appropriate management and supervision.
For participants in overseas exchange programs, we may provide necessary information to local host organizations and other relevant parties—after obtaining the individual’s consent—for the purposes of travel, lodging, hosting, emergency response, and other necessary arrangements.
Detailed handling of personal information is governed by the Association’s separate Privacy Policy.
Article 16 (External Services and External Sites)
This website may be operated using systems provided by Wix.com or other third-party providers.
This website may contain links to social media platforms, payment services, maps, video streaming services, or other external websites or services.
The terms of use and privacy policies of the respective service providers apply to the use of such external services.
The Association assumes no responsibility for the content, availability, or security of external websites or services, except in cases of willful misconduct or gross negligence on the part of the Association.
Article 17 (Suspension or Modification of This Site)
The Association may modify, suspend, or discontinue all or part of this Site or the Services without prior notice to users in any of the following cases:
When performing system maintenance, inspections, or updates;
When failures occur in communication lines, servers, payment systems, or other infrastructure;
When natural disasters, power outages, cyberattacks, or other force majeure events occur;
When complying with laws and regulations, administrative guidance, or requests from relevant organizations;
In any other case where it is reasonably determined to be necessary for operational purposes
Article 18 (Disclaimer and Scope of Liability)
The Association endeavors to provide information posted on this Site that is as accurate as possible; however, it does not guarantee its completeness, accuracy, usefulness, or timeliness.
Any disputes arising between Users or between a User and a third party shall be resolved between the parties involved, unless such disputes are attributable to the Association.
If a user suffers damage due to causes attributable to the Association, the Association shall compensate for such damage in accordance with applicable laws and within the scope of its liability.
With respect to damage caused by the Association’s slight negligence, the Association’s liability for compensation shall be limited to ordinary and direct damages; in the case of paid services, such liability shall be capped at the amount paid by the user to the Association for participation fees and other charges related to the service in question.
The limitation set forth in the preceding paragraph shall not apply to damages caused by the Association’s willful misconduct or gross negligence, damages to human life or bodily injury, or any other cases where the limitation of liability is not permitted under applicable laws and regulations.
The provisions of this Article shall apply to the extent permitted by the Consumer Contract Act and other mandatory laws and regulations.
Article 19 (Exclusion of Antisocial Forces)
Users shall represent that they do not belong to organized crime groups, are not members of such groups, are not associated with such groups, or are otherwise classified as antisocial forces, and that they do not have any socially reprehensible relationships with such entities.
If the Association reasonably determines that a user falls under the category of antisocial forces, the Association may refuse the application, terminate the contract, suspend participation, or take other necessary measures.
Article 20 (Amendments to These Terms and Conditions)
The Association may amend these Terms and Conditions in the event of revisions to laws and regulations, changes to the nature of its activities, or when otherwise necessary.
The amended Terms and Conditions will be made public by posting them on this website or by other appropriate means.
If the content of the amendments has a significant impact on Users, the Association will endeavor to provide notice with a reasonable advance notice period.
The amended Terms of Service shall apply to applications for the Service submitted after the amendment. For contracts formed prior to the amendment, the Terms of Service in effect at the time of application shall apply as a general rule, unless otherwise permitted by law or by agreement between the parties.
Article 21 (Severability)
Even if any part of these Terms of Service is deemed invalid or unenforceable by law or by a court ruling, the remaining provisions shall remain in full force and effect.
Article 22 (Governing Law and Jurisdiction)
These Terms and any contracts regarding the Service shall be governed by the laws of Japan.
In the event of a dispute regarding this Site or the Service, the Association and the User shall consult in good faith to seek a resolution.
If the dispute cannot be resolved through consultation, unless otherwise provided by law, the Tokyo District Court or the Tokyo Summary Court shall be the agreed-upon court of first instance.
